1 US crash survivor upgraded to fair condition

(AP) ? The condition has been upgraded for one of three people hospitalized following a crash that killed seven members of an extended Ecuadorean family.

Thirty-six-year-old Maria Antonia Yupa was listed in fair condition Saturday at South Bend Memorial Hospital. She had been listed as serious Friday.

Thirty-year-old Manuel Chimborazo remains in critical condition at South Bend. Police say he was driving the minivan packed with 10 people Thursday when it hit a deer and then was crushed from behind by a semi-trailer.

Officials at Elkhart General Hospital declined to release any information Saturday on 28-year-old Cayetano Quizhpe, who had been listed as stable Friday.

Police say the crash on the Indiana Toll Road killed three adults and four children, including Quizhpe's 6-week-old son.

Tara Fass: Caught In The Middle

The bifurcated child -- shuttling between the homes of his or her separated or divorced parents -- is, by definition, caught in the middle. Imagine the child as a bird migrating from one place to another, essentially homeless until you provide a safe perch. How can you help this child glide in for a smoother landing?

Most co-parents with issues, who seek mediation and counseling, are in some version of custody hell. When they seek my guidance, I'm sometimes reminded of Alice in "Through the Looking Glass," who finds that nothing is quite what it seems. We're talking about a mirror, after all, and frequently it's a funhouse mirror, a genie all distorted and bent out of shape. How can you bring reason to a genie that won't go easily back in the bottle?

If you've acted out in shameful and betraying ways in your relationship, or you've disengaged (grown cold and distant, or worse) from your children's other parent, it's helpful to remind yourself that you are not alone. But regardless of your mood from day to day, you need to take special care of your kids. They require a safe and steady, holding environment. They're growing up, whether you're fighting with your ex or trying to heal.

You must access the core resources to bow out of your romantic relationships with your heads held high -- setting a good example for your children and clearing the path to a brighter future. Trouble is if you are still in conflict mode with your former significant other, you are still in the throes of what I call the "emotional divorce."

You may have a tendency to obsess over your past love connection in the name of justice and fairness. But the competitive, tit-for-tat, scorekeeping approach doesn't help anyone, especially not your offspring, who absorb and feed off this poison. They're continuously watching us, but when children are on high-alert, they especially watch us like hawks and parrot back what we provide for them. Be careful what role-modeling seeds you sow -- down the road it will be a version of what you reap.

If you're still wrangling after the breakup, it's time to recalibrate. Not knowing how to stop your hurtful ways -- the very stuff that got you into trouble when you were together -- is proof positive that you need to let go of the past and take new steps. If your child is trying to fix your relationship or engaging in storytelling that is keeping him or her at the center of an imbroglio, that's another sign it's time to turn your attention to getting along with your co-parent.

Try to give your ex the benefit of the doubt, and trust but verify as my teacher, Isaac Berman, Ph.D advises. Just quieting down can speak volumes. Backing up is not giving up. Feeling lost? Focus on one good thing and remember what the kinder need. After all, they light you up and are the delightful result of your relationship with the co-parent.

Focus on the knottiest problems about how to share custody in a way that benefits the child. Dr. Berman says it's an art form to acquire a taste for what is odious to you. He thinks you can downplay the pain of conflict by conceiving of it as just another way to stay in touch that has outworn its value. Additionally, your enlightened self-interest should remind you if your former partner wins you win too. It follows then, that your child wins as well.

As you prepare for a session with your mediator or therapist, have the courage to internalize the message, "I am in conflict with someone I once cherished. How can I avoid being part of the problem and improve the situation?" Such radical honesty may soften your former mate and restore him or her to a more accommodating place, which it turn can ease the process of sharing custody in a way that makes the child feels comfortable in BOTH homes.

If you allow yourself to dwell on being disgusted with your situation, you may be inciting or feeding the problem. Only by acknowledging this will you have something substantial to work with to help you keeping the solemn promise to your raise your children right.

When dealing with the Bifurcated Child, each parent can be the dreaded finger pointer as well as the one the being pointed at. Stay mindful of the bigger picture, which is that every action you take, every mood you display, has an effect on your kids. And don't punish yourself when you make mistakes, or judge too harshly when your former significant other screws up.. As Leonard Cohen sang, "There is a crack in everything. That's how the light gets in." He could have been talking about illuminating your looking glass with that light.

Michael D. Higgins favored to win Irish presidency (AP)

DUBLIN ? Human rights activist and poet Michael D. Higgins looked on course Friday to be elected Ireland's president after his main rival suffered a last-minute collapse in support, according to senior politicians, electoral officials and an opinion poll.

"Michael D. Higgins looks pretty certain to be elected. ... I'm really delighted that he succeeded," said Deputy Prime Minister Eamon Gilmore of the governing Labour Party. Higgins is Labour's candidate.

And former Foreign Minister Micheal Martin, whose Fianna Fail party was ejected from office by angry voters earlier this year and didn't run a presidential candidate, said Higgins was guaranteed to win when full results are announced Saturday.

Martin said Higgins "will make an excellent president and ambassador for Ireland." He praised Higgins' "command of global issues and commitment to human rights."

Ballot-counters estimated that Higgins was leading with around 40 percent of first-preference votes, nearly double his main challenger, businessman and reality TV celebrity Sean Gallagher.

Pressing Gallagher for second place was former Irish Republican Army commander Martin McGuinness, who temporarily stepped down as deputy leader of the Northern Ireland government to make his first foray into southern Irish politics. McGuinness, who wasn't eligible to vote because he's a Northern Ireland resident, was expected to resume his government post in Belfast.

Four other candidates to be Ireland's ceremonial head of state trailed far behind. One of them, Dublin gay rights activist David Norris, conceded defeat and praised Higgins.

"I'm very happy to be an Irishman under the presidency of Michael D. Higgins," said Norris, who lauded his rival as a political maverick and social liberal who would "speak out on behalf of the marginalized."

Higgins, 70, is best known in Ireland as "Michael D," befitting his status as one of the country's most liked and instantly recognized politicians. He stands just 5 foot 4, his elfin features complemented with a much-parodied high voice infused with his rural County Clare roots.

Higgins, a former University College Galway lecturer in sociology and politics, is credited as an intellectual heavyweight of Irish politics with three published collections of poetry to his credit and a four-decade record of promoting home-grown arts, literature, film and the native Gaelic language. Unlike other English-only candidates and most of the nation, Higgins spoke the native Irish tongue fluently on the campaign trail.

He also has traveled the world defending left-wing human rights cases. He is one of Ireland's most ardent critics of U.S. foreign policy, particularly in Central America, Iraq and Afghanistan, and of Israel's policies versus the Palestinians.

His socialism came to the fore on the campaign trail as he condemned the get-rich-quick excesses of Ireland's lost Celtic Tiger boom economy, arguing its narcissism and greed left the country mired in debt and unemployment.

Analysts say Higgins is too far ahead for Gallagher to catch up as the counting runs into Saturday. Ireland's complex voting system permits voters to rate candidates in order of preference, which requires several rounds of ballot-counting.

Gallagher, an entrepreneur and the star judge on a business-talent TV competition called "Dragon's Den," had a 15-point lead in opinion polls versus Higgins until Monday ? when his image imploded during the campaign's last live TV debate.

McGuinness presented evidence that Gallagher had served as a "bagman," a collector of undocumented cash donations, from businessmen to Ireland's long-dominant Fianna Fail party. Voters threw Fianna Fail out of power in February after it was blamed for leading Ireland to the brink of bankruptcy and an international bailout.

Gallagher, who ran as an independent and downplayed his Fianna Fail background, stumbled as he tried to explain the circumstances of one donation he allegedly collected from a border fuel smuggler. Analysts said that admission linked Gallagher fatally in voters' minds to Fianna Fail's poor ethical record.

Higgins' campaign team seized on their candidate's own reputation for honesty and integrity as a point of contrast. Full-page newspaper ads on election day claimed that the "D" in Higgins' name stood for democracy and decency. It actually stands for Daniel.

A survey published Friday by Irish pollsters RedC said it telephoned 1,100 citizens Thursday after they had cast their ballots and detected a massive flight from Gallagher in the campaign's dying days.

About 38 percent said they had decided whom to support only following that TV debate. Some 28 percent said they had switched support in the past week ? and 58 percent of those said they had dumped Gallagher.

Stuntman killed on set of "The Expendables 2" (Reuters)

LOS ANGELES (Reuters) ? One stuntman was killed and another one seriously injured in an explosion the set of action film "The Expendables 2" in Bulgaria, the movie's production company said on Friday.

The stuntmen were part of a team that was filming scenes on Thursday at Lake Ognyanovo, a reservoir in Southwest Bulgaria, for the movie that stars Bruce Willis, John Travolta and Arnold Schwarzenegger, among a cast of high-profile Hollywood stars.

"It is with great regret that we confirm this unfortunate accident. Our hearts go out to the families and those on the production affected by this tragedy. The filmmakers are working closely with the authorities in responding to and investigating this accident," production company Nu Image/Millennium Films said in a statement.

The name of the deceased man was not released.

"Expendables 2" is the sequel to the 2010 box office hit about a team of mercenaries hired to kill a corrupt military man. The sequel is due for release in summer 2012 by the film division of Lions Gate Entertainment Corp.

Pink Floyd member's son loses jail term appeal

LONDON (AP) ? Appeal court judges on Friday upheld the 16-month jail sentence given to the son of Pink Floyd guitarist David Gilmour for a violent rampage during student protests last year.

Charlie Gilmour was one of thousands who demonstrated in December against rising university tuition fees and was among a group that broke away from the main demonstration and attacked a convoy carrying Prince Charles and his wife, Camilla. At Gilmour's trial earlier this year, a judge said Gilmour had jumped on the hood of a Jaguar in the royal motorcade and thrown a garbage can at the car.

Gilmour also kicked a store window, stole the leg of a mannequin and was photographed hanging from a Union flag on the Cenotaph, a memorial to British war dead.

The 21-year-old Cambridge University student, who has been in jail since July, pleaded guilty to violent disorder but challenged the length of his sentence.

But three appeals judges said the sentence was neither "manifestly excessive (nor) wrong in principle."

"We do not believe that violence in this context and of the kind displayed by this defendant can normally be met by other than significant sentences of immediate custody even for those of otherwise good character," said one of the three, Anthony Hughes.

He makes the comments on an upcoming TV show to promote his interest in protecting the forests of Romania's Transylvania region.

Charles says genealogy shows that he is related to Vlad, giving him a stake in the future of Romania. The prince has long worked to conserve the forests and has bought a home in the region.

On a visit to Romania earlier this year, he called Transylvania a national treasure because of its unspoiled landscape and centuries-old rural farming traditions.

Obama's Executive Order of the Day: Easing Student Loan Payments (The Atlantic Wire)

President Obama plans to announce today a two-pronged executive action to relief Americans' ever-growing student-loan burden.?According to The New York Times, the president will?"use his executive authority to expand the existing income-based repayment program with a 'Pay as You Earn' option that would allow graduates to pay 10 percent of their discretionary income for 20 years and have the rest of their federal student loan?debt forgiven." That's a bit better than low-income students' current situation, under which they "must pay 15 percent of their discretionary income for 25 years before having their debt forgiven." The second part of Obama's initiative "would allow the estimated 5.8 million people who hold both direct government student loans and government-backed private loans to consolidate their debts into one government loan"--getting borrowers an up to 0.5 percent reduction in their interest rate, The Wall Street Journal reports. The Journal notes that today is "the third day in a row Mr. Obama has announced an executive action aimed at bypassing Congress" meant to "jolt the economy." According to The Times more than 30,000 have petitioned the president for student-loan relief.?Last week the Federal Reserve reported that Americans now owe more than $1 trillion in student loans, which has exceeded credit card debt for the first time.

Economy grew 2.5 pct. in Q3 as consumers rebound (AP)

WASHINGTON ? A summer of modest economic growth is helping dispel lingering fears that another recession might be near. Whether the strength can be sustained, though, is far from clear.

Buoyed by a resurgent consumer and strong business investment, the economy expanded at an annual rate of 2.5 percent in the July-September quarter, the government said Thursday.

The expansion, the strongest quarterly growth in a year, came as a relief after anemic growth in the first half of the year and weeks of wild stock market shifts.

The economy must grow at nearly double the third-quarter pace to lower high unemployment, which has been near 9 percent for the more than two years since the recession officially ended.

And though consumer spending was triple the level of the second quarter, Americans earned less, on an inflation-adjusted basis, in the July-September period. That meant that many people financed their spending binges by cutting back on savings. Few economists think that can continue.

Economists believe that growth in consumer spending, which accounts for about 70 percent of economic activity, will be restrained until incomes start growing at healthier levels. That is unlikely until hiring picks up.

Paul Ashworth, chief U.S. economist for Capital Economics, predicts that growth will cool off in the fourth quarter and next year.

Nonetheless, the report on U.S. gross domestic product, or GDP, sketched a more optimistic picture for an economy that only two months ago seemed destined for another recession.

And it was delivered on the same day that European leaders announced a deal in which banks would take 50 percent losses on Greek debt and raise new capital to protect against defaults on sovereign debt.

Stocks surged on the European deal and maintained their gains after the report on U.S. growth was released.

"This has been a morning of encouraging news," said Jennifer Lee, a senior economist for BMO Capital Markets. "The fourth quarter may see some pullback in U.S. economic growth ... but the positive details underlying the GDP report should help ease fears of a U.S. recession..somewhat."

Consumers helped drive much of the growth. They spent at an annual rate of 2.4 percent. Many bought more furniture and clothing.

And spending on services rose 3 percent, the most in more than five years. Much of the gain was due to consumers paying more for health care and to cool their homes during an unseasonably hot summer.

Still, after-tax incomes adjusted for inflation fell at a rate of 1.7 percent in the summer. It was the biggest decline since the third quarter of 2009 ? just as the recession was ending.

Businesses also helped boost third-quarter growth by stepping up their investment in equipment and software. That category surged 17.4 percent ? nearly three times the rate from spring. They also invested more in building, a sign that some businesses could be expanding despite the sluggish economy.

The GDP report measures the country's total output of goods and services. It covers everything from bicycles to battleships, as well as services such as haircuts and doctor's visits.

In August, many feared the economy was destined for another recession after the government said growth fell to less than 1 percent for the first six months of the year.

High gas prices, the growing debt crisis in Europe and wild fluctuations in the stock market also contributed to those fears, which have receded in recent weeks after reports showed improvements in hiring and consumer spending.

Economists project an annual growth rate of 2.5 percent to 3 percent for the October-December quarter and for all of next year ? just enough to keep the unemployment rate from rising.

For the 14 million people who are out of work and want jobs, that's discouraging news. And it's an ominous sign for President Barack Obama, who will be facing voters next fall.

There have been some encouraging signs.

A measure of business investment plans rose in September for the second straight month and by the most in six months, according to a government report Wednesday on orders for longer-lasting manufactured goods.

And consumers stepped up their spending on retail goods in both July and September. The main reason for the September gain was more people bought new cars, a purchase people typically make when they are confident in their finances.

Economists warned that even their modest assessment of growth of around 2.7 percent for next year will fall short if the European debt crisis isn't resolved. And the outlook could dim further if U.S. lawmakers allow a Social Security tax cut and extended unemployment benefits to expire at the end of this year.

Review: 'Uncharted 3' another interactive treasure (AP)

It was somewhere around the sixth rooftop that I leapt from during a rollicking foot chase above the streets of Yemen that I realized "Uncharted 3: Drake's Deception" (Sony, $59.99 for PlayStation 3) is one of the best games I've played this year ? and maybe ever.

It's not because the gameplay is notably innovative or the story is particularly compelling. They're not. "Uncharted 3" is just unapologetically fun. The developers at Naughty Dog have stuck closely to the formula that garnered them awards, critical praise and game sales for "Uncharted 2: Among Thieves" by creating another interactive action experience that rivals anything Hollywood has churned out in the past four years.

"Uncharted 3" finds treasure hunter Nathan Drake, who claims to be a descendent of Sir Francis Drake, on a quest to uncover a mythical city known as the "Atlantis of the Sands" that's apparently buried somewhere in the Middle East. His journey is more personal this time, providing some much needed character development for Drake and his cohorts.

Nolan North again gives a pitch-perfect performance as Drake, and so do sidekicks Richard McGonagle as con man Victor "Sully" Sullivan, Emily Rose as journalist Elena Fisher, Claudia Black as grifter Chloe Frazer and Graham McTavish as henchman Charlie Cutter. Rosalind Ayres does a noble Helen Mirren impersonation as villainess Katherine Marlowe.

The game's exotic environments serve as the other, more gorgeous, stars of "Uncharted 3." A burning chateau in France, a pirated cruise ship in the Arabian Sea and the bustling streets in Yemen are a few of the exhilarating playgrounds where Drake can seamlessly switch among climbing, shooting, brawling and puzzle solving during his whirlwind adventure.

Yes, the plot is too similar to the previous "Uncharted" titles ? how many secret cities can one man uncover? But the pace is so rapid, and the action is peppered with so much humor and heart, that it hardly matters, especially in the game's more exciting later stages, some of which are surprisingly mind-bending and gut-wrenching for such a mainstream game.

"Uncharted 3" doesn't offer players any more freedom than its predecessor did two years ago, which is just fine by me because that's what the developers intended. I found the strict linear nature of "Uncharted 3" comforting after toying with such seemingly open-ended new releases as "Rage," "Dark Souls" and "Batman: Arkham City."

The only major gripe that I have with "Uncharted 3" is that it's no longer in uncharted territory. The differences from the second to the third installment are merely tweaks. The hand-to-hand combat system is sharper, and the multiplayer and cooperative modes are fuller, but they still lack the addictiveness of games like "Call of Duty" or "World of Warcraft."

The bar was set so high that "Uncharted 3" isn't quite able to surpass "Uncharted 2," despite a masterful blend of thrilling gameplay, cinematic storytelling and luscious graphics. I wonder if it's possible for Naughty Dog to ever top "Uncharted 2." I'm not sure. I just know I cannot wait to play "Uncharted 4" to find out. Four out of four stars.

Gov. Pat Quinn is replacing everyone on the Illinois Gaming Board except the chairman, an advocate for strong regulation of gambling.

Quinn said Monday that under Chairman Aaron Jaffe, the board ?has increased openness and transparency? in the gambling industry.

In a statement, the Democratic governor did not say why he was getting rid of the rest of the board. His office did not immediately return a message seeking comment.

Jaffe faces a major confirmation battle, mainly because he all but called legislators corrupt for passing the gaming expansion bill. I?m not sure about the others?

Maribeth Vander Weele of Chicago is the owner and founder of the Vander Weele Group, which provides investigative, security and integrity program services to the public and private sectors. She is also a certified Illinois inspector general with a strong financial and oversight background that includes service on the audit committee for Chicago Public Schools.

Lee Gould of Chicago has more than 30 years of experience as an accountant, auditor and tax preparer. Gould specializes in forensic accounting investigations, locating unreported or hidden assets and identifying misappropriations. Gould holds a degree in accounting from UIUC and a J.D. from the Loyola University of Chicago School of Law.

Michael Holewinski of Chicago is the president of Ace Industries and is a former Illinois state representative. He sits on the board of directors for the Illinois Manufacturer?s Association and previously chaired the Chicago Mayor?s Task Force on Youth Crime Prevention. He holds a J.D. from the John Marshall Law School.

Z (Zaldwaynaka) Scott of Chicago was Illinois? first executive inspector general and previously worked as a criminal prosecutor in the U.S. Attorney?s Office in Chicago. She is currently a partner at Kaye Scholer and a commissioner for the Chicago Housing Authority.

Z Scott resigned as Gov. Rod Blagojevich?s inspector general shortly after submitting a damning report on Blagojevich?s hiring practices?

The report also alleged job descriptions were changed to hire politically connected candidates chosen for positions before the jobs were posted publicly.

?It?s been common practice to put your buddies into jobs. But supposedly this governor was going to change all that, but all he did was perfect it,? state Sen. Gary Dahl, R-Granville.

* Speaking of gaming expansion, the Senate?s sponsor of the gaming bill told reporters yesterday how he intends to proceed. He said he hasn?t had any direct contacts with the governor?s office about the bill. He said he?ll be carrying the governor?s bill, and predicted Quinn?s proposal would receive at least two more votes than Rod Blagojevich?s GRT bill because he and Senate President Cullerton would be voting for it. Illinois Gov. Pat Quinn dumped Bill Morris, a former mayor of Waukegan, from the Illinois Tollway Board. Morris was, by far, the most critical of all the Tollway Board members when Gov. Quinn pushed for the unpopular raising of the tollway fees. The Board voted to raise the fees this past summer.

Besides showing Morris the exit door, the governor also saw it fit to tell George Pradel, who is the long-time mayor of Naperville, to get out, too.

The Board has nine members, and it will now include new member Mark Peterson who is the director of the Illinois Sports Facilities Authority and the president of Bridgeview Bank. In addition to Peterson, Quinn named other new members who are Jim Sweeney who is the president and business manager of International Union of Operating Engineers Local 150, Chicago Heights Mayor David Gonzalez, DuPage County Board member and lawyer Jeffrey Redick, and businessman Terrence D?Arcy who is the president of D?Arcy Buick and GMC which is located in southwest suburban Joliet.

Morris was moved to the Illinois Liquor Control Commission.

Quinn also appointed five new members to the Racing Board.

AP IMPACT: NYPD shadows Muslims who change names (AP)

NEW YORK ? Muslims who change their names to sound more traditionally American, as immigrants have done for generations, or who adopt Arabic names as a sign of their faith are often investigated and catalogued in secret New York Police Department intelligence files, according to documents obtained by The Associated Press.

The NYPD monitors everyone in the city who changes his or her name, according to internal police documents and interviews. For those whose names sound Arabic or might be from Muslim countries, police run comprehensive background checks that include reviewing travel records, criminal histories, business licenses and immigration documents. All this is recorded in police databases for supervisors, who review the names and select a handful of people for police to visit.

The program was conceived as a tripwire for police in the difficult hunt for homegrown terrorists, where there are no widely agreed upon warning signs. Like other NYPD intelligence programs created in the past decade, this one involved monitoring behavior protected by the First Amendment.

Since August, an Associated Press investigation has revealed a vast NYPD intelligence-collecting effort targeting Muslims following the terror attacks of September 2001. Police have conducted surveillance of entire Muslim neighborhoods, chronicling every aspect of daily life, including where people eat, pray and get their hair cut. Police infiltrated dozens of mosques and Muslim student groups and investigated hundreds more.

Monitoring name changes illustrates how the threat of terrorism now casts suspicion over what historically has been part of America's story. For centuries, immigrants have Americanized their names in New York. The Roosevelts were once the van Rosenvelts. Fashion designer Ralph Lauren was born Ralph Lifshitz. Donald Trump's grandfather changed the family name from Drumpf.

David Cohen, the NYPD's intelligence chief, worried that would-be terrorists could use their new names to lie low in New York, current and former officials recalled. Reviewing name changes was intended to identify people who either Americanized their names or took Arabic names for the first time, said the officials, who insisted on anonymity because they were not authorized to discuss the program.

NYPD spokesman Paul Browne did not respond to messages left over two days asking about the legal justification for the program and whether it had identified any terrorists.

The goal was to find a way to spot terrorists like Daood Gilani and Carlos Bledsoe before they attacked.

Gilani, a Chicago man, changed his name to the unremarkable David Coleman Headley to avoid suspicion as he helped plan the 2008 terrorist shooting spree in Mumbai, India. Bledsoe, of Tennessee, changed his name to Abdulhakim Mujahid Muhammad in 2007 and, two years later, killed one soldier and wounded another in a shooting at a recruiting station in Little Rock, Ark.

Sometime around 2008, state court officials began sending the NYPD information about new name changes, said Ron Younkins, the court's chief of operations. The court regularly sends updates to police, he said. The information is all public, and he said the court was not aware of how police used it.

The NYPD program began as a purely analytical exercise, according to documents and interviews. Police reviewed the names received from the court and selected some for background checks that included city, state and federal criminal databases as well as federal immigration and Treasury Department databases that identified foreign travel.

Early on, police added people with American names to the list so that if details of the program ever leaked out, the department would not be accused of profiling, according to one person briefed on the program.

On one police document from that period, 2 out of every 3 people who were investigated had changed their names to or from something that could be read as Arabic-sounding.

All the names that were investigated, even those whose background checks came up empty, were cataloged so police could refer to them in the future.

The legal justification for the program is unclear from the documents obtained by the AP. Because of its history of spying on anti-war protesters and political activists, the NYPD has long been required to follow a federal court order when gathering intelligence. That order allows the department to conduct background checks only when police have information about possible criminal activity, and only as part of "prompt and extremely limited" checking of leads.

The NYPD's rules also prohibit opening investigations based solely on activities protected by the First Amendment. Federal courts have held that people have a right to change their names and, in the case of religious conversion, that right is protected by the First Amendment.

The NYPD is not alone in its monitoring of Muslim neighborhoods. The FBI has its own ethnic mapping program that singled out Muslim communities and agents have been criticized for targeting mosques.

The name change program is an example of how, while the NYPD says it operates under the same rules as the FBI, police have at times gone beyond what is allowed by the federal government. The FBI would not be allowed to run a similar program because of First Amendment and privacy concerns and because the goal is too vague and the program too broad, according to FBI rules and interviews with federal officials.

Police expanded their efforts in late 2009, according to documents and interviews. After analysts ran background checks, police began selecting a handful of people to visit and interview.

Internally, some police groused about the program. Many people who were approached didn't want to talk and police couldn't force them to.

A Pakistani cab driver, for instance, told police he did not want to talk to them about why he took Sheikh as a new last name, documents show.

Police also knew that a would-be terrorist who Americanized his name in hopes of lying low was unlikely to confess as much to detectives. In fact, of those who agreed to talk at all, many said they Americanized their names because they were being harassed or were having problems getting a job and thought a new name would help.

But as with other intelligence programs at the NYPD, Cohen hoped it would send a message to would-be bombers that police were watching, current and former officials said.

As it expanded, the program began to target Muslims even more directly, drawing criticism from Stuart Parker, an in-house NYPD lawyer, who said there had to be standards for who was being interviewed, a person involved in the discussions recalled. In response, police interviewed people with Arabic-sounding names but only if their background checks matched specific criteria.

The names of those who were interviewed, even those who chose not to speak with police, were recorded in police reports storied in the department's database, according to documents and interviews, while names of those who received only background checks were kept in a separate file in the Intelligence Division.

Donna Gabaccia, director of the Immigration History Research Center at the University of Minnesota, said that for many families, name changes are important aspects of the American story. Despite the myth that officials at Ellis Island Americanized the names of people arriving in the U.S., most immigrants changed their names themselves to avoid ridicule and discrimination or just to fit in, she said.

The NYPD program, she said, turned that story on its head.

"In the past, you changed your name in response to stigmatization," she said. "And now, you change your name and you are stigmatized. There's just something very sad about this."

As for converts to Islam, the religion does not require them to take Arabic names but many do as a way to publicly identify their faith, said Jonathan Brown, a Georgetown University professor of Islamic studies.

Taking an Arabic name might be a sign that someone is more religious, Brown said, but it doesn't necessarily suggest someone is more radical. He said law enforcement nationwide has often confused the two points in the fight against terrorism.

"It's just an example of the silly, conveyor-belt approach they have, where anyone who gets more religious is by definition more dangerous," Brown said.

Sarah Feinstein-Borenstein, a 75-year-old Jewish woman who lives on Manhattan's Upper West Side, was surprised to learn that she was among the Americans drawn into the NYPD program in its infancy. She hyphenated her last name in 2009. Police investigated and recorded her information in a police intelligence file because of it.

"It's rather shocking to me," she said. "I think they would have better things to do. It's is a waste of my tax money."

Feinstein-Borenstein was born in Egypt and lived there until the Suez Crisis in 1956. With a French mother and a Jewish religion, she and her family were labeled "undesirable" and were kicked out. She came to the U.S. in 1963.

"If you live long enough," she said, "you see everything."

Prosecution rests case against Jackson physician (AP)

LOS ANGELES ? Prosecutors concluded their case Monday against the doctor charged with Michael Jackson's death after questioning 33 witnesses, including an expert who said the physician committed numerous violations of medical practices that made him solely responsible for the singer's death.

Defense attorneys quickly called their first two witnesses.

One was Dona Norris, a records custodian for the Beverly Hills Police Department who briefly discussed the timing of the 911 call received on the day Jackson died.

They also called a police surveillance specialist who retrieved grainy surveillance footage shot outside Jackson's home on the day of his death.

The specialist, Alexander Supall, told jurors he only collected a few minutes of footage taken around the time Jackson arrived home after a June 25, 2009, rehearsal for his comeback concerts.

The witnesses were among 15 expected to be called by the defense over the next few days.

The final prosecution witness against defendant Dr. Conrad Murray was Dr. Steven Shafer, an expert on the anesthetic propofol that authorities say killed Jackson.

Shafer, a Columbia University researcher and professor, said Jackson had been receiving propofol almost every night for more than two months, according to a police statement by Murray. The Houston-based cardiologist has pleaded not guilty to involuntary manslaughter.

Shafer previously testified that he thinks a propofol overdose killed Jackson. But he said Murray kept no records about how much of the drug he gave the singer.

Shafer told jurors that it's difficult to know the precise effects of the drug on the singer because he had been given so much of it in the months before he died.

Shafer made the statement while being cross-examined by lead defense attorney Ed Chernoff, who noted the risk that Jackson would stop breathing should have been low after the first few minutes the drug was administered on the day he died.

Chernoff based that conclusion on models and research done by Shafer.

"In Mr. Jackson's case, it's harder to have that certainty," Shafer replied. "There's very little, almost no precedent for this level of propofol exposure."

Shafer has said the only possible explanation for Jackson's death based on the evidence was that Murray put the singer on an IV drip of propofol then left the room after the singer appeared to be asleep.

Murray's attorneys will try to counter four weeks of damaging testimony from prosecution witnesses who have cast Murray as an inept, distracted and opportunistic doctor who repeatedly broke legal, ethical and professional guidelines.

Murray's attorneys have not publicly revealed whether they will call him to testify.

Jurors have heard from the doctor through a more than two-hour interview with police, and it seems unlikely his attorneys would subject their client to what would be blistering questioning from prosecutors.

Shafer never retreated from his position that Murray is solely responsible for Jackson's death and that the cardiologist committed 17 egregious violations of medical practices that each could have either led to Jackson's serious injury or death.

Out of sight of the jury, the defense's theory has shifted in recent months from arguing that Jackson swallowed propofol and gave himself the fatal dose to suggesting the singer had swallowed several pills of the sedative lorazepam that led to his death.

Delhi race a game-changer for Sauber chief (Reuters)

LONDON (Reuters) ? India's first Grand Prix this weekend could be the breakthrough that changes the way the country's businesses look at Formula One, according to Sauber chief executive Monisha Kaltenborn.

Her Swiss-based team are sponsored by dairy company Amul for Sunday's Delhi race and she suggested other firms might also now see the sport as part of a bigger picture rather than just focusing on one or two local drivers at the slow end of the grid.

"In India, all these years, it's been so difficult to get a sponsor from the country," the Indian-born Kaltenborn told Reuters in an interview.

"India has got such big brands and the market is huge and still people have been very cautious to get into Formula One.

"It wasn't that easy (for a team) to get a brand from India without having any link to a (local) driver. So I think it's all the more remarkable a brand (like Amul) has done this and I hope a lot more will follow now," added Kaltenborn.

Narain Karthikeyan is the only Indian to have scored points in Formula One, with the now-defunct Jordan team in 2005, and he will be back on the starting grid with struggling HRT for Sunday's race at the Buddh International circuit.

While he has healthy support from industrial giants Tata and Hero Motors, Karthikeyan will still be languishing among the tailenders.

Spanish-owned HRT have yet to score a point since their debut in 2010 and Karthikeyan's is likely to be a one-off home appearance after he was dropped to make way for Australian rookie Daniel Ricciardo.

Karun Chandhok, India's other F1 driver, is now only a reserve at Team Lotus -- also yet to score a point.

Sauber have Mexican Sergio Perez and Japan's Kamui Kobayashi as their drivers and are battling against Force India for sixth place in the constructor championship.

Force India, owned by liquor and aviation tycoon Vijay Mallya along with Indian business conglomerate Sahara Group, do not have Indian drivers either.

DIRECT LINK

"Maybe more (Indian companies) will follow that don't necessarily just look for the link with the driver," continued Kaltenborn, an Austrian citizen who is married to a German and lives in Switzerland.

"Here it's the team, the people, the drivers, the key personnel. I think if one brand is prepared to associate themselves with the team, and a team name, I hope it gives others the kick as well to do that."

Kaltenborn said the arrival of India on what is now a 19-race global calendar provided a direct link with the public for local companies to build on.

"Since cricket is so big (in India) it takes a lot now for a company to say 'No, we choose the platform of Formula One'," she said.

"Until there was a race there was not really a link to the sport. Now with the first race being staged there they have a direct link, they can use it in their prime market.

"It could be the start of something to attract more Indian partners into the sport."

Many of those companies may not have products to sell outside India but the likes of Sauber are hoping they will wake up to what the sport can provide in increasing brand visibility to a growing domestic audience who watch the races on television.

Telecom giant Bharti Airtel has already signed up for the race title sponsorship.

Kaltenborn, who was born in Dehradun and whose parents emigrated to Austria in 1979 when she was eight, looked forward to going to a race in a country where she had a personal as well as professional connection.

"I think it's going to be really great," she said.

"Suddenly the media attention and also from the people has just ramped up whereas half a year ago it was not that much. It has just suddenly come. I think that tells you what dimension this event is going to have."

Yen soars on weak US economy news, euro woes (AP)

The Japanese yen rose against other major currencies Tuesday after U.S. consumer sentiment weakened and talks on Europe's debt crisis appeared to break down.

The dollar fell to a record low against the yen after news that U.S. consumers' views of the economy are the worst since the middle of the Great Recession. The Conference Board's index of consumer sentiment was the worst since March 2009, far lower than analysts had expected.

The yen is considered safer than most currencies because it is less likely to lose value quickly, and because holders can use yen to invest in Japanese companies.

The dollar rose to 75.96 yen at 1:42 Eastern time from 76 late Monday. It fell to a record low of 75.71 at 11 a.m.

The yen has benefited from recent signs that the U.S. economy is barely growing. Both the dollar and yen are considered safe compared to other currencies, so they tend to rise when markets get rattled and the economy weakens. When the U.S. economy shudders, the yen's appeal over the dollar increases.

The euro plunged against the yen after European finance ministers canceled a planned meeting ahead of a much-hyped summit about the debt crisis there. Leaders appear unable to agree on a set of measures aimed at propping up banks, bailing out Greece and preventing the contagion from spreading to larger countries.

Investors have been hoping that a plan to address the crisis would be agreed to at a summit on Wednesday. The plan was originally scheduled to be released on Sunday.

The euro fell to 105.71 yen from 106.1 late Monday. It sank as low as 105.25 just after 11 a.m.

In other trading, the euro fell to $1.3918 from $1.3951 late Monday. The pound rose to $1.6006 from $1.6002.

The dollar soared a percent against the Canadian dollar, to 1.0141 Canadian dollar from 1.0043.

James Murdoch to testify again to UK committee (AP)

LONDON ? British lawmakers said Monday they will grill Rupert Murdoch's son James about newspaper phone hacking for a second time next month, as Murdoch's former right-hand man denied that he knew about the scale of the wrongdoing when he paid almost 250,000 pounds ($400,000) to a reporter convicted of illegal eavesdropping.

The House of Commons Culture, Media and Sport committee said James Murdoch, his father's heir-apparent, will give evidence on Nov. 10.

Rupert Murdoch shut down the 168-year-old British tabloid News of the World in July after it was accused of illegally hacking into the voice mails of celebrities, politicians and even crime victims in search of scoops.

Both Murdochs denied knowing about the scale of the wrongdoing when they appeared before the panel of lawmakers the same month.

Former News. Corp. employees have since cast doubt on the Murdochs' testimony. Ex-company lawyer Jonathan Chapman rejected the notion that the two had been kept in the dark by subordinates, saying their statements had contained "serious inaccuracies."

Other senior executives have backed the Murdochs' claim that they did not know News of the World reporters regularly hacked phones and paid police officers for information.

Some News Corp. critics ? and shareholders ? have called for James Murdoch to resign from his post as CEO of his father's international division over the scandal.

Les Hinton, former publisher of the Murdoch-owned Wall Street Journal and one of Rupert Murdoch's closest allies, said he considered that unlikely.

"I see no reason why James Murdoch should resign," he told the panel of lawmakers Monday.

Hinton worked for Murdoch for 52 years until the scandal, which has convulsed Britain's media landscape. In July he resigned as publisher of the Journal and CEO of Dow Jones & Co. ? the most senior Murdoch executive claimed by the furor.

Hinton said Monday he had resigned because "although unaware, I was in charge of this company at the time of the core wrongdoing."

The former publisher said he had had no idea hacking was rife when he personally approved a quarter of a million pound payment to Clive Goodman, the News of the World reporter jailed in 2007 for eavesdropping on the mobile phone voice mails of royal aides.

Hinton, who was then executive chairman of Murdoch's British newspaper division, acknowledged he had seen a letter from Goodman to the company's human resources department in which the reporter alleged phone hacking was widespread at the paper and common knowledge among editors.

Hinton, 67, said he had launched a "pretty thorough" internal investigation into Goodman's claim, but said "there was no basis found for it."

He said he fired Goodman for gross misconduct, but decided to pay him the substantial sum, almost three times the reporter's annual salary, to end an unfair dismissal claim by Goodman.

"I decided at the time that the right thing to do was to settle this and put it behind us," Hinton said, giving evidence by video link from the United States.

The phone hacking scandal has forced the resignation of two of London's top police officers and claimed the job of Prime Minister David Cameron's former spin doctor, Andy Coulson, an ex-News of the World editor. More than a dozen people have been arrested in the last year, including Coulson, though none has yet been charged.

Murdoch's global News Corp. has expressed contrition, launched an internal inquiry and set aside 20 million pounds ($32 million) to compensate victims, who could number in the hundreds. Dozens of alleged hacking victims, from lawmakers and sports figures to Hollywood star Jude Law, are suing the company.

In previous appearances before the committee in 2007 and 2009, Hinton said he had seen no evidence that phone hacking went beyond a single rogue reporter, Goodman.

On Monday he denied he had misled the committee, but said "the full picture" of what had happened was still emerging.

"I think it's clear ... that some of the answers you were given were not accurate," Hinton said. "Whether 'untruthful' is the right word, I don't know."

Hinton claimed he was hazy on details of what happened several years ago, answering "I don't remember" or "I am foggy on this detail," to several questions ? to the exasperation of some members of the committee.

Labour lawmaker Paul Farrelly asked whether Hinton thought he had been "kept in the dark" by those beneath him.

"I can't answer that question," Hinton said, "as I don't know what happened."

Simoncelli dies after Sepang crash (Reuters)

REUTERS ? Italy's Marco Simoncelli has died after a crash at the Malaysian MotoGP in Sepang, organisers said on Sunday. He was 24.

The race was cancelled after just four minutes when Simoncelli fell and was hit by Colin Edwards and Valentino Rossi as he slid across the track on his Honda.

Simoncelli's helmet was knocked off in the incident and the race was immediately red-flagged.

(AP) ? A Dutch court Friday rejected a suit brought by one of the Netherlands' best-known gangsters seeking to block the release of a film about the 1983 kidnapping of beer tycoon Freddy Heineken.

Willem Holleeder, dubbed "The Nose" in the Dutch media, was sentenced to 11 years in prison for his role in kidnapping Heineken and his chauffeur and holding them captive in soundproof cells in an Amsterdam warehouse for three weeks until his family paid a $36 million ransom.

Though all four kidnappers were eventually caught, about 20 percent of the money was never recovered.

Holleeder's lawyers claimed the movie "The Heineken Kidnapping," starring Rutger Hauer as the victim, would damage Holleeder's image by making him appear more sadistic than he really is.

In a summary ruling, judge Wil Tonkens of the Amsterdam District Court rejected the suit without comment and said she will publish her reasoning Oct. 28.

Lawyers for producers IDTV Film had argued the movie is a fictionalized version of events.

Holleeder, now 53, is not named in the movie, and filmmakers said they merged his character with that of another of the four real-life kidnappers ? although one of the actors resembles Holleeder physically, including the prominent nose that is the source of his nickname.

The defense lawyers also argued Holleeder has little reputation left to lose.

He launched the suit from his cell in a high-security prison where he is serving a new nine-year sentence on unrelated extortion charges. One of his victims was real estate magnate Willem Endstra, who had given a statement to police about a shakedown by Holleeder. Endstra's subsequent murder in 2003 has not been solved.

IDTV lawyer Jens van den Brink said halting the ?4.7 million ($6.4 million) production just days before its Oct. 24 release would have been financially ruinous.

Heineken's family also declined to cooperate with the filmmakers. He had inherited a small family concern and built it into the world's third-largest brewer. After the kidnapping, Heineken became more reclusive and was believed to be the Netherlands' richest man, worth $3.6 billion when he died of pneumonia in 2002.

The two other living kidnappers have also said they don't want the film to go forward. The fourth, Cor van Hout, was slain in an unsolved gangland killing in 2003.

An American film based on the Heineken kidnapping also is under negotiation with a different production company.

Art school -- incubator of tomorrow's next great visionaries, or think tank for the Robot Apocalypse? Sorry folks, but this latest Arduino frankenconcept looks to be working against Team Humanity. Part of Art Institute of Chicago BFA student Daniel Jay Bertner's recent oeuvre, the Tracking Interactive Mechanism (or T.I.M., for short) uses a webcam operating OpenCV to follow gallery-traipsing gawkers' faces, and respond to their movements. Careful, though. T.I.M. here bites, or at least makes virtual attempts to pierce your flesh thanks to a hidden photocell mechanism triggered by a viewer's proximity. There's just one thing Daniel left out of his wall-mounted, predatory cyborg installation -- the requisite Hannibal Lecter soundboard.
