THE 'SOCIAL PROBLEM' OF CYBER-BULLYING |

Technology has provided many benefits to society however with these comes new platforms for harassment and abuse.[i] Cyber-bullying is of growing concern as youths have increased access to the Internet.[ii] In a 2006 study in the United Kingdom, 98% of adolescents reported having regular access to the internet,[iii] with 40% of US youths experiencing cyber-bullying.[iv] ?Cyber-bullying can be defined as intentionally and repeatedly inflicting harm[v] through the use of electronic devices such as computers and mobile phones.[vi] This differs from face-to-face bullying as technology is the medium[vii] and the bully may remain anonymous.[viii] Issues such as cyber-stalking, child grooming and vilification[ix] will not be covered in this essay as they differ from cyber-bullying as with the latter the victim and the bully both must be a child or youth.[x] Cyber-bullying should be classified as a legal problem with its own specific legal remedies. This coupled with prevention policies and education programs are necessary to reduce its occurrence.[xi] ?

II CYBER-BULLYING AS A LEGAL PROBLEM

To effectively reduce the negative outcomes of cyber-bullying it must be classified as a legal issue. Firstly, it would allow the child to understand the severity of their actions[xii] and secondly it may deter other youths.[xiii] Gregory Ainsley, a J.D. Candidate from the University of Wisconsin Law School, argues that by making this act a crime a great proportion of youths would be ?felons?.[xiv] However the seriousness of the crime will seldom be realised without legal ramifications and is thus necessary to reduce the number of offenders.

Additionally, courts are in the best position to deal with this problem, as techniques employed by schools and parents once the bullying has occurred are often ineffective.[xv] It is commonly proposed that schools are in the better position to educate and punish cyber bullies[xvi] however there are three main flaws in this suggestion. Firstly, as the Ryan Halligan case illustrates, solutions suggested by parents or schools are commonly rejected by victim of cyber-bullying[xvii] often as it results in the removal of access to technology.[xviii] Therefore many victims fail to report incidences. Implementing a legal ramification for cyber-bullying will not only make youths less likely to commit the offence but will also provide a more feasible solution for the victims. Currently victims may only pursue non-specific remedies through actions such as suing the aggressor for assault, defamation or intentional infliction of emotional distress.[xix] Secondly, schools often deal with instances of bullying through suspension. This does not prevent the bully from continuing to harass their victim from their home.[xx] Therefore due to this crucial difference between cyber-bullying and face-to-face bullying, previous methods of punishment and control cease to be effective. Lastly, schools are unsure and unguided as to the point at which they can intervene with ?off-campus? bullying[xxi] and therefore may fail to act. Thus through the classification of cyber-bullying as a legal issue, the seriousness of which it is dealt with will be increased, deterrence will increase, jurisdiction of the crime will become more lucid and additional access to justice for victims will ensue.

III THE VALUE OF A SPECIFIC LEGAL REMEDY

In Australia, neither Victoria nor the Commonwealth have implemented legislation specific to cyber-bullying.[xxii] Notwithstanding this, all jurisdictions, except WA, have specific anti-stalking legislation[xxiii] indicating a movement toward online regulation. ?As a result of the lack of specific legislation, cyber-bullying offences are being characterized as no more than harassment or a manifestation of personal violence[xxiv] regardless of the outcome. The American case of Tyler Clementi illustrates the need for those guilty of cyber-bullying to be punished by a specific law with a specific legal remedy.[xxv] Such a tailored offence is required to ensure that offenders don?t avoid sufficient sentences as seen with the mere thirty-day imprisonment of Dharun Ravi.[xxvi] Therefore the courts should establish a legal remedy that is suitable and consistent with the grave outcomes the act produces.

IV POTENTIAL REGULATION REFORMS

In addition to specific legislation addressing cyber-bullying as a crime, a number of other avenues in the form of education, training and policy require implementation in order to fulfill an effective preventative approach.

Primarily, schools must be empowered and equipped with the tools to prevent cyber-bullying.[xxvii] Such is a difficult and large aim but it would be beneficial to begin through increased training of teachers[xxviii] to educate them of the most recent developments. Furthermore, it would seem beneficial to train education providers of how to educate youths on identifying and managing risks associated with social media.[xxix]

Within the cyber-bullying legislation, schools should be given guidance on what policies are necessary to implement and the type of liability the school may incur.[xxx] In Virginia, the cyber-bullying laws describe how schools must handle bullying incidents[xxxi] and encourage the implementation of a comprehensive program to educate youths on how to avoid cyber-bullying and how to react when they are being bullied.[xxxii]There have been issues for schools in determining the boundaries of their jurisdiction and the extent to which they are to investigate outside of school incidents[xxxiii]. Legislation must clearly spell out this boundary and thus make the divide transparent.

Furthermore, a hybrid of The Washington and the New Hampshire Approach, suggested by Ainsley, may be a potential reform that effectively addresses the concerns of cyber-bullying.[xxxiv] This includes the implementation of regular training for teachers, mandates clear reporting procedures, promotes community involvement and empowers schools to get involved in cyber-bullying instances outside of school property.

It is argued that education is the most vital aspect of avoiding criminally sanctioning youths.[xxxv] Education is indeed essential as it aids the preventative approach and may reduce offending rates however alone it is ineffective. Cyber-bullying as a legal problem in combination with effective education will aid in providing management of this issue.

V CONCLUSION

Cyber-bullying will continue escalating in prevalence if it is not adequately addressed. The classification of such bullying as a legal problem will send a clear message of its severity and also provide a sustainable avenue to victims. Furthermore, education and government policy in conjunction with the legal classification of cyber-bullying may effectively reduce the incidence and thus the negative outcomes by implementing a complete preventative approach.[xxxvi]

Movie Review: 'The Possession' ? CBS Philly

(Jeffrey Dean Morgan and Kyra Sedgwick are the parents of a demonically possessed daughter in ?The Possession.?)

By Bill Wine
KYW Newsradio 1060

PHILADELPHIA (CBS) ? What possessed the possessors of The Possession to boast so prominently that their horror thriller was ?based on a true story??

True?? This chronicle of the terrifying supernatural ordeal that a fractured family of four experienced over the course of a month feels about as true as a wobbly ladder.

2c2bd1 Movie Review: The Possession

(2? stars out of 4)

And yet?and yet.

A Jewish-themed Exorcist, The Possession, despite its surface preposterousness, does get under your skin, at least far enough to produce the requisite shivers.

Jeffrey Dean Morgan and Kyra Sedgwick play the divorced parents of two daughters.? Their split wasn?t amicable and either is their shared custody.? But they manage.

When their younger daughter, a ten-year-old played by Natasha Calis, purchases a seemingly innocuous antique wooden box at a lawn sale, she becomes obsessed with it.

Just a stage, they figure.

But then she starts exhibiting uncharacteristically bizarre and even menacing and violent behavior that gets the nervous concern of not only her parents and older sister (Madison Davenport) but the school authorities as well.

What a panicky investigation of the Hebrew inscription on the box and appropriate Jewish folklore indicates is that a malevolent force -? a dybbuk, or dislocated ancient spirit of a deceased person who has been denied entrance to the afterlife ? is inside and that the diabolical apparition has taken over the host girl?s body and soul.

Producer Sam Raimi, who knows a thing or two about the horror genre as a producer and director (The Evil Dead, Army of Darkness, Drag Me to Hell) has mounted a film that starts off as if it?s to be suffocatingly overwrought, but that then settles in and goes about its respectable business of making us squirm.

The Danish director, Ole Bornedal (Nightwatch), punctuates his atmospheric chiller ? from a screenplay by Juliet Snowden and Stiles White that was inspired by a Los Angeles Times article entitled ?Jinx in a Box? ? with abrupt music cues and shock scares that are generic and obligatory, all right, but are effectively creepy anyway.

And he makes resourceful use of imaginative CGI?flourishes that enhance the spooky imagery.

Meanwhile, Morgan and Sedgwick lend presence to the fear-for-one?s-children?s-welfare proceedings without breaking a sweat, and the youngsters are persuasively natural, especially the impressive Calis, who remains the center of attention once she takes possession of the box.

Crucially, the film avoids the always-distasteful spectacle of child-in-jeopardy exploitation by assigning the jeopardy to the adults around the possessed child rather than the child herself.

So we?ll inhabit 2? stars out of 4 for the supernatural horror thriller The Possession, an unnerving variation-on-a-theme exercise in exorcising.

Learn How To Invest In Commercial Real Estate With These Ideas ...

You must research and stay patient in order to be successful at investing in commercial property. A number of newcomers to commercial real estate investing have successfully learned the ropes and turned a tidy profit. The purpose of this article is to educate you about some of those basics so you too can experience success.

Before settling on a broker, determine if they negotiate aggressively or rationally. Ask how they were trained and how much experience they have. In addition, you should ensure that the methods they employ are ethical and that they know how to go about obtaining the best deals. Request additional information or examples of the results from previous negotiations.

Pest Control

Be sure to have a professional building inspector go through your property before you put it up for sale. If anything turns up during the inspection, you should immediately address the problem.

TIP! Locate a lender prior to putting in an offer for a commercial property. Discover your area?s best lenders by talking to friends and investors that you know.

If you are renting or leasing, be sure to know about pest control arrangements. Talk to your rental professional regarding pest control policy if you rent in a community known for bug or rodent infestation.

It is possible to spend less money cleaning up environmental hazards on commercial property. Typically you are only required to pay for the cleanup costs if you own a piece of the property. The price of disposing environmental waste can cost a fortune. Try getting a report about the environment from one of the environmental assessment agencies. This can cost you a good bit of money, but it will save you in the long run.

Have family, friends, and professional lenders partner with you to make sure you have enough cash to buy commercial real estate. The best way to establish a solid group of partners is to have preset contracts in place that document the rate of repayment or how they can earn a portion of your profits from the real estate.

Investors of commercial real estate should be sure to be conscious that drastic inflation is a real possibility in the near future and shouldn?t overlook it when thinking about buying. In the past, most leases had various built-in clauses that had their price adjusted to the CPI, which protected those who signed from inflation. However, these days, this is rarely done, which means inflation could hit you where it hurts the most.

TIP! Consult with your tax adviser prior to purchasing any commercial real estate property. Your tax adviser can inform you of all of the potential costs related to your investment, and also tell you what percentage of your profits will have to be paid in taxes.

Try to get a presence online prior to jumping into the market. These days, a website is a must as are accounts on professional networking sites like LinkedIn. Try to learn about SEO to optimize your site. Your goal is to have people instantly find information about you when they type your name in to a search engine.

Dual Agency

Check any disclosures a potential real estate agent gives you carefully. Try to beware of dual agency. In a dual agency the Realtor represents both parties of the transaction. Or, for short, the agent is looking out for both parties? interests. If there is a dual agency, everyone should be honest about it and find an agreement.

Tour any properties you are considering for purchase. Definitely consider having a professional contractor go with you when looking at potential properties. Make a proposal early, and get into the beginning stages of negotiation. Consider counteroffers carefully prior to responding.

TIP! One of the most important things you should be aware of is emergency maintenance. Ask in advance who will be handling any emergencies that arise.

The advice you have just read should help you get started on the right foot in commercial real estate. If you use the tips provided in this article, you will see why so many people are successful at commercial real estate, and you can start to reap the

US bank earnings rose 21 percent in 2Q, lending up

WASHINGTON (AP) ? U.S. bank earnings rose 21 percent in the April-June quarter and lending to consumers increased, adding to evidence that the industry is strengthening four years after the financial crisis.

The Federal Deposit Insurance Corp. said Tuesday that the banking industry earned $34.5 billion in the second quarter, up from $28.5 billion in the second quarter of 2011.

About 63 percent of U.S. banks reported improved earnings as they were able to set aside less for losses on loans. And the number of troubled banks fell for the fifth straight quarter.

Banks became less cautious about lending. Bank loans to consumers increased in most categories, including credit card loans and home mortgages, reversing a first-quarter decline.

"The industry continues to recover at a gradual but steady pace," FDIC Chairman Martin Gruenberg said at a news conference.

Still, the gains in revenue remain "sluggish," Gruenberg said. Total revenue increased only $1.3 billion ? a slim 0.8 percent ? in the second quarter from a year earlier.

Gruenberg said that the industry's bottom line was affected by JPMorgan Chase & Co.'s nearly $6 billion in trading losses revealed recently from a soured bet in its London operation. "It certainly impacted the results, and without that I think it would have been a stronger picture," he said.

JPMorgan reported second-quarter net income of $5 billion, or $1.21 per share, down from $5.4 billion, or $1.27 per share, a year earlier.

Banks with assets exceeding $10 billion drove the bulk of the earnings growth in the April-June period. While they make up just 1.5 percent of U.S. banks, they accounted for about 77 percent of the earnings.

Those banks include Bank of America Corp., Citigroup Inc., JPMorgan and Wells Fargo & Co. Most of them have recovered with help from federal bailout money and record-low borrowing rates.

The number of banks on the FDIC's confidential "problem" list fell in the second quarter to 732, or around 10 percent of all federally insured banks. That compares with 772 troubled banks in the first quarter.

So far this year, 40 banks have failed. That's far below the 92 banks that shuttered last year and the 157 that closed in 2010 ? the most for one year since the height of the savings and loan crisis in 1992.

In the second quarter, fewer bank failures allowed the insurance fund to strengthen. The fund, which turned from deficit to positive in the second quarter of 2011, had a $22.7 billion balance as of June 30, according to the FDIC. That compares with $15.3 billion at the end of March.

The FDIC is backed by the government, and its deposits are guaranteed up to $250,000 per account. Apart from its deposit insurance fund, the agency also has tens of billions in loss reserves.

New mileage standards would double fuel efficiency

WASHINGTON (AP) ? The Obama administration has finalized regulations that will force automakers to nearly double the average gas mileage of all new cars and trucks they sell by 2025.

The rules mean that all new vehicles would have to get an average of 54.5 miles per gallon in 13 years, up from 28.6 mpg at the end of last year. The requirements will be phased in gradually between now and then, and automakers could be fined if they don't comply.

The regulations, announced Tuesday, will change the cars and trucks sold in U.S. showrooms, with the goal of slashing greenhouse gas emissions and fuel consumption. Automakers will need to improve gasoline-powered engines, and sell more alternative fuel vehicles. Critics say the rules will make cars unaffordable by adding thousands of dollars to the sticker price.

The "Corporate Average Fuel Economy," or CAFE standards, will vary by automaker depending on the mix of models they sell. The requirements will be lower for companies such as General Motors, Ford and Chrysler, which offer more pickup trucks. The standards can be lowered by the government if people suddenly start buying less-efficient vehicles in the future, although few expect that to happen.

The administration says the latest changes will save families up to $7,400 on fuel over the life of a vehicle. The standards also are the biggest step the U.S. government has ever taken toward cutting greenhouse gas emissions, Environmental Protection Agency Administrator Lisa Jackson said. Tailpipe emissions from cars and light trucks will be halved by 2025.

President Barack Obama said the new fuel standards "represent the single most important step" his administration has taken to reduce U.S. dependence on foreign oil.

But Republican presidential nominee Mitt Romney has opposed the standards, and his campaign on Tuesday said any savings at the pump would be wiped out by the rising cost of cars and trucks.

Already, automakers have committed to an average of 35.5 mpg by model year 2016 under a deal reached with the Obama administration three years ago.

In the arcane world of government regulations, the rules don't mean that each new car or truck will get 54.5 mpg. The average vehicle will get closer to 40 mpg in real-world driving. Automakers will be able to sell pickup trucks and less-efficient vehicles as long as that's offset somewhat by smaller vehicles that already can get upward of 40 mpg.

Automakers can reduce the mileage they're required to get with credits for selling natural gas and electric vehicles, changing air conditioning fluid to one that pollutes less, and adding stop-start circuits that temporarily shut off the engine at stop lights.

At showrooms, dealers are likely to offer more efficient gas-electric hybrids, natural gas vehicles and electric cars. There also will be smaller motors, lighter bodies and more devices to save fuel.

Automakers have already been adding technology to boost the efficiency of gasoline-powered engines, mainly because people want to spend less at the pump. Fuel economy is the top factor people consider when buying a car in the U.S., according to the research firm J.D. Power and Associates. The national average for gasoline hit $3.76 Tuesday, the highest price ever for this time of year.

Fuel efficiency has been rising for the past five years because government regulations and high gas prices have encouraged smaller vehicles and engines. The average new car now goes almost four miles farther on a gallon of gas than it did in October of 2007, according to the University of Michigan Transportation Research Institute.

Market demand for more efficient vehicles already has pushed the auto industry to boost mileage with an array of technology, said Roland Hwang, transportation director for the Natural Resources Defense Council. "We're pleasantly surprised to see how fast the industry is moving," he said.

The administration estimates that the new rules, combined with those that began in 2011, will raise the cost of a new car about $2,800 by 2025. The estimates are based on 2010 dollars. But the government says the net savings from the requirements still will be $3,500 to $5,000 because people will spend less on gas.

The administration also predicts that the new regulations will cost the auto industry about $135 billion from 2017 to 2025.

The new rules were adopted after an agreement between the administration and 13 automakers last year. That's a change from the past, when automakers fought the regulations, saying they cost too much.

Industry leaders repeatedly told the Obama administration that they wanted one nationwide fuel standard, fearing separate mileage standards from California and other states.

"They wanted certainty so that as they invest in the future they will know what rules they are playing by," the EPA's Jackson said.

Fuel economy standards were first imposed on U.S. automakers in the 1970s. The aim was to make cars more efficient and reduce the nation's dependence on foreign oil at time when the Arab oil embargo was creating gasoline shortages. The administration says this is the first update in decades.

The National Highway Traffic Safety Administration will enforce the standards, calculating the average mileage of cars sold by each automaker. Automakers can be fined if they don't comply.

The requirements, which can be imposed without congressional approval, will be reviewed in 2018 and could be reduced if the technology isn't available to meet the standards.

The rules are tough, but General Motors, the largest U.S. car company, will roll out features to comply, spokesman Greg Martin said.

"Consumers want higher fuel efficiency in their cars and trucks, and GM is going to give it to them," he said.

Health risks posed to people who work with tiny fibers used in manufacturing industries could be reduced, thanks to new research

Health risks posed to people who work with tiny fibres used in manufacturing industries could be reduced, thanks to new research.

Research into the health risks posed by nanofibres used to strengthen objects from tennis rackets to airplane wings has pinpointed the lengths at which these fibres are harmful to the lungs.

Nanofibres, which can be made from a range of materials including carbon, are about 1,000 times smaller than the width of a human hair and can reach the lung cavity when inhaled.

This may lead to a cancer known as mesothelioma, which is known to be caused by breathing in asbestos fibres, which are similar to nanofibres.

The study by the University of Edinburgh found that lung cells were not affected by short fibres that were less than five-thousandths of a millimetre long.

However, longer fibres can reach the lung cavity, where they become stuck and cause disease.

Ken Donaldson, Professor of Respiratory Toxicology at the University of Edinburgh, said: "Concern has been expressed that new kinds of nanofibres being made by nanotechnology industries might pose a risk because they have a similar shape to asbestos.

"We knew that long fibres, compared with shorter fibres, could cause tumours but until now we did not know the cut-off length at which this happened. Knowing the length beyond which the tiny fibres can cause disease is important in ensuring that safe fibres are made in the future as well as helping to understand the current risk from asbestos and other fibres."

The researchers, whose study is published in the journal Toxicology Sciences, created fibres of different lengths using minute silver casts. They then looked at the effect of these fibres on mouse cells to reach their findings.

USCCAR Condemns UN Cover-up in Iraq, Calls for Swift Investigation Following Revelations by Former Senior UN official

WASHINGTON, Aug. 22, 2012 /PRNewswire-USNewswire/ -- The U.S. Committee for Camp Ashraf Residents (USCCAR) has learnt of shocking revelations made by Mr. Tahar Boumedra, chief of the Human Rights Office for the United Nations Assistance Mission for Iraq (UNAMI), regarding the outrageous cover-up by Ambassador Martin Kobler, the United Nations Secretary-General's Special Representative for Iraq, to deceive the international community about the prison-like conditions at Camp Liberty.?

Since February 2012, some 2,000 residents of Camp Ashraf ? home since 1986 to members of Iran's principal opposition group, the People's Mojahedin Organization of Iran (PMOI/MEK) ? have relocated to Camp Liberty after Mr. Kobler assured them of satisfactory living conditions there.?

The revelation by the former senior UN official leaves no doubt that the UN process, currently directed by Mr. Kobler, to resolve the humanitarian crisis at Camps Ashraf and Liberty utterly lacks transparency and accountability. USCCAR calls on the UN Secretary General Ban Ki-moon to immediately order a swift internal investigation into this matter.?

We urge Secretary of State Hillary Clinton to also launch an investigation into these revelations. She must assure the U.S. families of residents of camps Ashraf and Liberty that the State Department was in no way a participant in Mr. Kobler's cover-up efforts or had any knowledge of it. In the past several months, the State Department has astonished many with its defense of Mr. Kobler's less than impartial handling of the Camp Ashraf case. ?

3 Energy Issues No One's Talking About

If recent campaign events by both the Democratic and Republican presidential candidates are any indication, energy policy is going to be a major political chip in the race for the White House.

President Obama and Mitt Romney have diametrically opposed views on energy security, efficiency, and innovation. That brings seemingly minute issues such as a wind tax energy credit (crucial to Iowans, coincidentally) to the forefront as well as more philosophical issues such as whether the government should subsidize companies researching and producing renewable energy sources.

But beyond the media blitz surrounding a few select issues in a few select politically important states, a host of other energy issues affecting America's energy security and future remain hidden from public discourse.

Here's a look at just a few prickly, but important, energy issues that few are talking about:

The coal industry. Though it might seem like a business from a bygone era, coal mining and its use to produce energy are still key issues for many states, including some that could go either way come the November election.

[Read: Wind Energy Tax Credit: More Hot Air or Key Job Creator?]

That isn't lost upon Mitt Romney, who visited eastern Ohio in a campaign stop last week. Surrounded by some 75 miners, the Republican challenger pledged his support for the industry and dinged the Obama administration's tight regulation of coal plants.

But regulation of coal plants isn't the only thing that's squeezing the industry. Plentiful natural gas reserves have made the United States the largest natural gas producer in the world, according to the Institute for Energy Research, and that's made deposits of the resource in Texas, Alaska, and Wyoming increasingly attractive.

"Neither candidate's position [on the future of the coal industry] has been terribly well defined," says Mike Lynch, president and director of global petroleum service at Strategic Energy & Economic Research. "The big challenge right now is that coal is being clobbered by cheap natural gas not so much by regulation, and neither [Romney] nor Obama has addressed that."

Although coal is relatively cheap, it hasn't been able to compete with the flood of cheap natural gas recently. Coal is also harder to transport, dirtier, and the modern plants needed to produce electricity from coal are costly. A recent report also shows that carbon-dioxide emissions from the energy sector dropped to their lowest levels in 20 years, a feat many experts credit to the increased use of natural gas.

As a result, natural gas has been creeping up on coal's market share of energy production, which is bad news for jobs supported by the coal industry in some swing states.

"Natural gas prices have shocked everyone," Lynch continues. "I don't think either candidate knows what they're going to do about coal mining."

Energy exports. Last December, the Energy Information Administration announced a milestone. The United States become a net exporter of refined petroleum products for the first time since 1949, thanks in part to declining domestic demand and new oil discoveries in North Dakota and Texas.

[Read: Rising Building Material Costs Could Crimp Construction Gains.]

But as oil production and refining has ramped up in the United States, supply has far oustripped demand in nearby domestic markets, dually dampened over the years by increasingly fuel efficient vehicles and more recently by a sickly economy. As a result, many times distributors often find better sales environments abroad in energy-hungry developing countries in South America and China.

"If exports of fuels refined in America continue as a trend rather than proving to be a one-time anomaly, it will be a positive development for American energy security," Charles Drevna, president of the National Petrochemical & Refiners Association, said in a statement. "It will also result in more American jobs, more tax revenue for government at all levels, and a faster recovery for our nation's economy."

But oil isn't the only energy source America could export. The nation's vast supplies of coal and natural gas are valuable to growing nations abroad. Still, not everyone is keen on sending energy sources overseas. For starters, transporting coal to ports would involve some not-so-picturesque byproducts and environmental concerns.

"There's some opposition in Oregon to building better ports [equipped to handle the increased volume of exports]," Lynch says. "It's partly NIMBY as in 'We don't want more coal trains going through our backyards' and partly environmental as in 'We don't want China burning more coal.'"

With natural gas exports, some opponents fear shipping more abroad could push up prices here in the States. But, Lynch doesn't see much logic in that.

"Nobody says don't send lobsters to Boston to keep the price low in Maine," he adds.

Nuclear. Nuclear energy provides about 20 percent of the nation's electricity--a bedrock part of the electricity grid, according to experts--but lately, there's been a lot of uncertainty about the future of the industry, especially when it comes to disposing of spent fuel.

[Read: In Canada, China Sees Greater Opportunities to Secure Oil Reserves.]

With Yucca Mountain in Nevada eliminated as a candidate for a national repository for nuclear waste, nuclear power plants have no long-term option for storing waste. Instead, they now store the waste on site in pools or casks. Efforts are underway to identify a new site, but no time frame has yet been set.

A recent U.S. Court of Appeals decision ruled that a temporary solution is not good enough to meet federal environmental standards. As a result, the Nuclear Regulatory Commission has halted issuing new licenses for nuclear power plants, putting at risk the expansion of nuclear power in the United States.

Although the decision doesn't immediately affect any power plants, the speed bump could push back application processing for a year or more.

"What the impact [of the court ruling on potential future plant licenses or renewals for existing licenses] will be is hard to say," says David McIntyre, a spokesman for the NRC. "On new reactors, there are only three on schedule to be completed over the next couple of years and hopefully we'll have resolved this issue by then."

In the meantime, the NRC is focusing on addressing the court's ruling, McIntyre stresses. The agency's response, and hopefully more certainty for the industry, should be coming out soon.

Until then, new nuclear energy reactors--and the future of the industry--are on hold indefinitely.

Lawmaker's 'rape' gaffe pushes abortion into US race

White House rivals President Barack Obama and Mitt Romney condemned Monday a Republican lawmaker's shock claim that women can prevent pregnancy during rape, sparking an abortion debate likely to impact the election campaign.

But while Romney scrambled to distance his campaign from his party ally's statement, Obama seized on the gaffe to embarrass his opponent and underline the gap between their positions.

Congressman Todd Akin, his party's nominee for the Senate race in Missouri, triggered outrage Sunday when he said a woman's body can block an unwanted pregnancy during what he termed a "legitimate rape."

Akin's claim, which is unsupported by science, has been used in the past by some Christian conservatives to justify their opposition to abortion, even those in cases of rape.

But even as Akin defiantly refused to bow out Monday, the walls were rapidly closing in on the congressman, with the Republican Party reportedly shutting off funding for him and flagbearer Romney quick to condemn the remarks.

Several other high-ranking party figures, including Senate Minority Leader Mitch McConnell, fearful of seeing the Republican plan to woo women and independent voters away from Democrats derailed, also waded in.

Obama acknowledged Romney had distanced himself, but nevertheless found a way to twist the knife during an appearance at the White House briefing room, telling reporters: "First of all, the views expressed were offensive.

"Rape is rape, and the idea we should be parsing... what types of rape we are talking about doesn't make sense to the American people," he said, quickly turning to the broader issue of abortion rights.

"What I think that these comments do underscore is why we should not have a bunch of politicians, a majority of whom are men, making health care decisions on behalf of women," Obama said.

Akin's remark angered Romney.

"Congressman Akin's comments on rape are insulting, inexcusable, and, frankly, wrong," Romney told the conservative National Review Online. "Like millions of other Americans, we found them to be offensive."

In his comments, Akin had appeared to suggest that some women falsely allege rape in order to justify abortion. "If it's a legitimate rape, the female body has ways to try to shut that whole thing down," he said.

Romney dismissed this claim and said: "I have an entirely different view. What he said is entirely without merit and he should correct it."

Amid a growing backlash, Akin apologized, saying on the Mike Huckabee Show, a syndicated radio program, that he used "absolutely the wrong word" and that his comments were "a very, very serious error."

But he also suggested he was not going to stand down in his race against incumbent Democrat Claire McCaskill.

"I'm not a quitter. My belief is we're going to take this thing forward, and by the grace of God, to win this race," Akin said.

While he said no one from the Romney campaign had called him to demand he stand down, several Republicans publicly urged Akin to pull out, including Senator Scott Brown, from Massachusetts where Romney was once governor.

"Not only should he apologize, but I believe Representative Akin's statement was so far out of bounds that he should resign the nomination for US Senate."

Republican National Committee chairman Reince Priebus gave voice to what many Republicans were undoubtedly thinking.

"If it was me I would do the right thing and step aside," Priebus told Missouri's KMOX radio.

Akin's remarks also have been seized upon by Democrats, including McCaskill, who was fundraising on Akin's remarks.

"For most Missourians I hope this is one of those gut check moments when they realize this is not somebody we want speaking for us and for our values on the floor of the United States Senate," she told MSNBC news.

Despite his condemnation of Akin's outburst, and his pro-choice position during his time as Massachusetts governor, Romney is campaigning on an anti-abortion ticket.

He wants the US Supreme Court, whose members are appointed by the president, to overturn "Roe V. Wade", the landmark 1973 ruling that upholds the legality of abortion.

Romney's vice-presidential running mate, congressman Paul Ryan, partnered with Akin in 2009 to co-sponsor a "personhood bill" which declared a fertilized egg is entitled to the same legal rights as a person, and would have essentially outlawed abortion even in the case of rape or incest.

"I'm as pro-life as a person gets," Ryan told the conservative Weekly Standard magazine in 2010.

Madonna sued in Russia for supporting gays

MOSCOW (AP) ? Some Russian activists have sued Madonna for millions of dollars, claiming they were offended by her support for gay rights during a recent concert in St. Petersburg.

Anti-gay sentiment is strong in Russia. In St. Petersburg, a law passed in February makes it illegal to promote homosexuality to minors, and the author of that law has pointed to the presence of children as young as 12 at Madonna's concert on Aug. 9.

Russian news agencies quote Alexander Pochuyev, a lawyer representing the nine activists, as saying the suit was filed Friday against Madonna, the organizer of her concert, and the hall where it was held, asking for damages totaling 333 million rubles, or nearly $10.5 million.

Responding to criticism that the plaintiffs were stuck in the Middle Ages, the lawyer said they were using civilized, modern methods to defend their rights. "No one is burning anyone at the stake or carrying out an Inquisition," Pochuyev was quoted by RIA Novosti as saying. "Modern civilization requires tolerance and respect for different values."

The complaint includes a video taken at the concert showing Madonna stomping on an Orthodox cross and asking fans to raise their hands to show the pink armbands in support of gays and lesbians that were distributed among the audience, the new agency reported.

Madonna's spokeswoman, Liz Rosenberg, did not immediately respond to emails asking for the singer's reaction to the lawsuit.

Madonna also has angered conservative Russians with her support for Pussy Riot. Three members of the punk band were sentenced Friday to two years in prison for a protest inside Moscow's main cathedral against Vladimir Putin and his cozy relationship with the Russian Orthodox Church.

Madonna spoke out in support of the group during her concert in St. Petersburg and two days earlier in Moscow. After the verdict was issued, Madonna called on "all those who love freedom to condemn this unjust punishment."

Bioshock custom rig is Big Daddy of pinball machines, gives players a taste of Rapture

If you're going to revisit a certain underwater dystopia, you might as well have a ball. At least that's the approach being taken by Sweden-based DIYer rasmadrak, who has decided to build a Bioshock-themed custom pinball machine just for kicks. The project is filled with lots of neat little touches from Rapture, including Little Sister vents and a few Big Daddy homages. The builder also does a pretty good job of drilling into the details and providing insight on the creation process -- like the challenge in using two different systems such as Arduino and chipKIT together, for example -- via detailed posts in the Poor Man's Pinball! blog. The project proved to be a pleasant shock to the system for fellow pinball aficionado Ben Heck, who gave the project a sprinkling of Heckendorn love via Twitter. Pinball geeks can also follow the saga, so to speak, by checking out the source link below.
